Andrea Armas In the News – Lawsuit Settled in Case of McDonald’s Worker

A sex offender with an extensive criminal history — including repeated arrests on suspicion of exposing himself — was arrested after he was caught touching himself in front of a girl inside a Seminole County McDonald’s where he was working.  The incident eventually led to a guilty conviction for Robert Jonathan Walyus, and the victim’s filing a lawsuit against him, McDonald’s Corp. and the local-franchise owner.  The lawsuit claims McDonald’s failed to require the local-franchise owner, John Petrakis and his company, Jonco Inc., to employ reasonable hiring and supervision practices, which would prevent sex offenders or dangerous felons from working in their restaurants. Now, nearly four years after the incident, the parties have reached a private settlement.

The victim’s attorney, Andrea Armas, said her client would not comment. Walyus also wouldn’t comment for this article, and a woman who answered Jonco’s phone said no one there would talk about the lawsuit either.
The suit claims managers at the McDonald’s at 1920 W. State Road 426 near Oviedo and Jonco’s director of operations knew Walyus was a registered sex offender before the April 2007 incident.
At that time, he was on probation for a sex offense involving a 9-year-old girl, the suit said.

Walyus, now 27, had an arrest history, with charges including kidnapping, sexual assault, burglary and indecent exposure. Orange County Sheriff’s Office records show that from late August 2001 to early October 2001, he was arrested four times on suspicion of touching himself in public or exposing himself. In February 2003, Walyus was sentenced to nine years’ probation for lewd and lascivious exhibition involving a child under 16 for one of those incidents. The lawsuit claims that Walyus’ managers and Jonco “assured” Walyus’ probation officers that he wouldn’t have unsupervised access to minors in their restaurants. According to a Seminole County Sheriff’s Office report and the lawsuit, Walyus was working at the McDonald’s on April 4, 2007, as a janitor, when a 14-year-old girl visited the restaurant with her mother. During their meal, Walyus made direct eye contact with the teen, exposed himself, smiled and began touching himself, the lawsuit said. The teen was shocked and embarrassed, the suit said.

Walyus was arrested, convicted and designated by a court as a sexual predator.
